In a September ruling, the court found that the president “exceeded his authority” under Section 232 of the Trade Expansion Act. Those tariffs—imposed for so-called national security reasons—were declared “invalid, void, and of no legal force or effect.”
The challengers, a coalition of importers and downstream manufacturers, argued the administration ignored the law’s requirement for a full, transparent investigation into domestic steel capacity. Judge Christopher Cooper agreed, saying Commerce Secretary Wilbur Ross failed to consider the impact on all U.S. producers and rushed to impose duties without proper notice or comment.
